Description of processing and categories of data subjects

Agriturismo Le Macine processes personal data of its customers to allow booking, the provision of hospitality services and additional services, as well as to comply with the legal obligations provided by current legislation.

The processing concerns:

customers;
guests;
companions;
members of the family or group;
minors;
contacts of any client companies or organizations.

Data is processed in compliance with the Regulation (UE) 2016/679 (GDPR), ensuring the protection of the rights and fundamental freedoms of the data subjects, with particular attention to privacy and the protection of personal data.

Types of data collected

During the contractual relationship, the following categories of personal data may be collected and processed:

first name and last name;
residential address;
telephone contacts;
indirizzo e-mail;
company data;
identity document;
tax code;
coordinate bancarie;
data necessary for the management of payments, deposits and pre-authorizations (within the strictly necessary limits);
accounting and tax data;
period of stay;
information relating to the members of the reservation;
technical data regarding the use of the facility's Wi-Fi network (IP address, device used, connection and disconnection times).

Minors

The personal data of minors are processed exclusively for the purposes related to the stay, to the mandatory communication to the Public Security Authorities and to the possible application of the exemptions provided for by the regulations on the tourist tax.

Obligation of identification

Pursuant to art. 109 of the Consolidated Law on Public Security, the accommodation facility cannot host people without a valid identity document.

Personal data are generally collected directly from the data subject.

In some cases they may be obtained through:

online booking portals;
travel agencies;
authorized intermediaries;

Purpose of processing

Personal data are processed for the following purposes:

Booking management and provision of accommodation services and requested ancillary services.
Fulfillment of public security obligations, through notification of guests' personal details to the Police Headquarters, as provided for by the article. 109 of the Royal Decree. 18 giugno 1931 n. 773 and by the Decree of the Ministry of the Interior 7 January 2013.
Fulfillment of obligations related to the tourist tax, including any exemptions provided for by the applicable municipal regulations.
Administrative obligations, contabili e fiscali, as required by current legislation.
Facilitation of future bookings, through the retention of already acquired personal details, exclusively with the consent of the person concerned.
Security of the Wi-Fi network and IT systems, protection of company assets and any defensive needs.
Sending of the newsletter, containing informational communications, promotional and commercial messages related to the services, offers and initiatives of Agriturismo Le Macine, previo consenso dell’interessato.
Invio di comunicazioni commerciali tramite telefono cellulare, previo consenso.

Il conferimento del consenso per finalità di marketing e per la conservazione dei dati finalizzata ad agevolare i successivi soggiorni è facoltativo.

L’eventuale mancato consenso non pregiudica la possibilità di effettuare la prenotazione, stay at the facility or use the requested services.

Any consent given can be revoked at any time, without affecting the lawfulness of the processing carried out prior to the revocation.

Recipients of personal data

Personal data are not subject to dissemination.

They may be processed:

by authorized personnel of Agriturismo Le Macine;
by specifically appointed collaborators;
by external parties providing services necessary for the performance of the activity.

Among these are, by way of example:

IT service providers;
hosting services;
email service providers;
cloud services;
website maintenance;
platforms for managing bookings;
providers of cookie and consent management systems.

Tali soggetti operano, a seconda dei casi, such as Data Processors, ai sensi dell’art. 28 of the GDPR, or such as Data Controllers.

Data transfer to third countries

I dati personali sono trattati prevalentemente all’interno dell’Unione Europea.

Qualora, for technical needs related to the use of IT services, cloud platforms or other digital tools, if the transfer of data to non-EU countries or international organizations becomes necessary, the Controller will verify that such transfer takes place in compliance with the provisions set out in the articles 45 e 46 of the Regulation (UE) 2016/679.

In particular, the transfer may take place exclusively:

on the basis of an adequacy decision by the European Commission;
or through the adoption of the appropriate safeguards provided by the legislation, including, where applicable, the Standard Contractual Clauses (Standard Contractual Clauses – SCC).

Data retention period

I dati personali saranno conservati per il tempo strettamente necessario all’erogazione dei servizi richiesti e per tutta la durata del rapporto contrattuale.

Successivamente saranno conservati per il periodo necessario all’adempimento degli obblighi amministrativi, contabili e fiscali previsti dalla normativa vigente, generalmente per dieci anni, salvo eventuali termini più lunghi imposti da accertamenti, verifiche o contenziosi.

Dati comunicati all’Autorità di Pubblica Sicurezza

I dati identificativi degli ospiti e gli estremi del documento di identità sono trattati esclusivamente per adempiere agli obblighi previsti dall’art. 109 of the Consolidated Law on Public Security.

Gli eventuali elenchi predisposti esclusivamente per tale comunicazione vengono cancellati o distrutti non appena ottenuta la ricevuta dell’avvenuta trasmissione.

The receipts proving the sending are kept for cinque anni.

Regular customers

At the request of the data subject, the facility may keep some data to facilitate and speed up the registration procedures for future stays.

Such data will be kept until the withdrawal of consent or, in any case, for the period strictly necessary to achieve this purpose.

Newsletter and promotional communications

The data used for sending newsletters and commercial communications will be kept until the withdrawal of consent or the exercise of the right to object by the data subject.

In any case, the retention period will not exceed 24 months, unless the consent is renewed where requested.

Wi-Fi Service

I dati relativi all’utilizzo della rete Wi-Fi della struttura saranno conservati esclusivamente per il periodo necessario all’erogazione del servizio, fatti salvi eventuali obblighi di legge o esigenze di tutela dei diritti del Titolare.

Modalità del trattamento

I dati personali sono trattati nel rispetto dei principi di liceità, correttezza, trasparenza, minimizzazione e sicurezza previsti dal Regolamento (UE) 2016/679.

Il trattamento avviene mediante strumenti:

cartacei;
informatici;
telematici;

adottando misure tecniche e organizzative idonee a garantire la sicurezza, l’integrità e la riservatezza dei dati personali.

I dati relativi alla gestione degli ospiti sono conservati presso la sede operativa del Titolare.

Diritti dell’interessato

Ai sensi degli articoli da 15 at 22 of the Regulation (UE) 2016/679, l’interessato può esercitare in qualsiasi momento i seguenti diritti:

ottenere l’accesso ai propri dati personali;
richiedere la rettifica dei dati inesatti o incompleti;
richiedere la cancellazione dei dati nei casi previsti dalla legge;
obtain the limitation of treatment;
opporsi al trattamento nei casi consentiti;
ricevere i dati in formato strutturato e richiederne la portabilità;
revocare il consenso precedentemente prestato, quando il trattamento si basa sul consenso;
proporre reclamo all’Autorità Garante per la Protezione dei Dati Personali o ricorrere all’Autorità giudiziaria competente.

Le richieste saranno gestite gratuitamente e riceveranno riscontro nel più breve tempo possibile e, comunque, entro i termini previsti dal Regolamento (UE) 2016/679.

Processi decisionali automatizzati

Il Titolare del trattamento non effettua processi decisionali automatizzati, né attività di profilazione automatizzata, relativamente ai trattamenti descritti nella presente informativa.
